Dockerizit End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "Licensee") and CodeLifter ("we", "us") governing your use of the Dockerizit software, including its bundled container engine, updates and documentation (together, the "Software").

By downloading, installing or using the Software you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

1. License grant

1.1 Personal use (free)

We grant you a free, non-exclusive, non-transferable license to install and use the Software for personal, non-commercial purposes — hobby projects, learning, open-source work you do outside of employment, and evaluation.

1.2 Commercial use (paid)

Commercial use means any use of the Software for or on behalf of a business, employer, client, or other for-profit activity, including use by employees and contractors in the course of their work.

Commercial use is permitted free of charge for a 30-day evaluation period beginning on first commercial use. After the evaluation period, commercial use requires a valid paid license, purchased per user. A license permits one named user to activate the Software on the number of machines allowed by that license.

The Software never disables features. Continued commercial use without a valid license after the evaluation period is a violation of this Agreement, not a technical restriction.

2. Restrictions

You may not:

  • redistribute, sell, rent, lease or sublicense the Software or modified versions of it;
  • reverse engineer, decompile or disassemble the Software except to the extent applicable law permits despite this limitation;
  • remove or alter any proprietary notices in the Software;
  • use the Software to provide a competing hosted or bundled service.

Downloading official release binaries for use under this Agreement is permitted and encouraged.

3. Ownership

The Software is licensed, not sold. We retain all right, title and interest in and to the Software. Third-party components bundled with the Software (for example the Linux guest, container runtime components, vfkit and gvproxy) are licensed under their own open-source licenses, which are unaffected by this Agreement.

4. Updates

We may provide updates at our discretion. Updates are covered by this Agreement unless accompanied by a replacement agreement.

5. Termination

This Agreement terminates automatically if you breach it. Upon termination you must stop using the Software and delete all copies. Sections 3, 6 and 7 survive termination.

6. Disclaimer of warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU USE THE SOFTWARE AT YOUR OWN RISK. CONTAINERS AND THE DATA INSIDE THEM ARE YOUR RESPONSIBILITY — BACK UP ANYTHING YOU CARE ABOUT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. General

This Agreement is the entire agreement between you and us concerning the Software. If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.
